Privacy Policy

Privacy Information for MPower SMART Mind Software Users


This software is classified as Medical device stand-alone software and conforms to the requirements set forth by the UK Medical Devices Regulations (UK MDR)2002, as amended, and is classified as a Class I Medical Device. It carries the UKCA (UK Conformity Assessed) mark.


The instructions on the platform should be followed carefully by the user and information given should be honest. If the wrong information is entered by the individual, the reports generated may not give accurate results. 


Ensure that you update the software if indicated by MPower IT support.


If an individual, after using the Platform, has any immediate concerns with the report information generated then they should consult a healthcare professional, either one of our MPower Healthcare Professionals or their GP.


If the platform does not work as stated e.g

· If the instructions are not clear or the platform is difficult to use

· If there are any concerns around the safety of the software or the information that it provides, please report to us at IT.support@mpower.com


· If this does not resolve any concerns you can report to the MHRA via reporting system https://yellowcard.mhra.gov.uk/


Personal Data and Security:


What Information do we hold?

Personal records or information that we will hold though the use of SMART Mind are:

Name, e.mail, contact number.

Age range, gender identity, biological sex, marital status, disability status, job role, ethnicity and the input responses to survey questions.


What do we do with the Information?

This tool is a symptom checker only. It does NOT facilitate direct diagnosis. SMART Mind is intended for personal use and should not be used as a substitute for professional mental health advice or treatment. The tool will indicate the likelihood of matching mental health and well-being conditions, but further assessment will be required to make any diagnoses and treatment plans.

Where necessary, the tool will direct individuals to appropriate support pathways, provided by the medical health professionals and coaches of MPower Mental Health limited


How do we protect the confidentiality of the personal information?

All information is stored in a secure server and in accordance to the Data Protection Act 1998 (GDPR) standards.

If an individual wishes to make a formal request to see specific information held about themselves, then a written request can be made to MPower Mental Health limited but proof of identity will be required or provision of written authority if information is to be disclosed to a third party.

Anyone working for MPower Mental Health Ltd is required to keep information confidential.

Individual reports can only be accessed via the encrypted portal.


Using Personal Information for Marketing

MPower Mental Health Ltd will not use any personal details for the marketing of any services.


Undertaking IT System testing

To improve the IT systems to provide a more efficient service, it may be necessary to use the information provided for system testing. MPower Mental Health Ltd ensure that any testing is carried out in a secure and controlled environment.


Processing Information Outside of the UK

If it is necessary to process any personal information outside the United Kingdom, MPower Mental health Limited will ensure that it is secure and protected. Information. Will not be transferred. Abroad without suitable safeguards to meet the requirements of the Data Protection Act 1998 being in place.


Sharing Personal Information


Individual data:

Information may be shared with other healthcare or support workers or coaching professionals who are involved in the provision of care, support, treatment, or coaching of that individual only.


Individual Information or data that is personally identifiable will only be shared with other organisations that are not directly contributing to an individuals care, support, treatment or coaching with the consent of that individual and for particular circumstances :

· to make arrangements for funding or payment of services an individual has received or

· Where there are exceptional circumstances such as when the health and safety of others is at risk or the law requires MPower Mental Health Limited to pass on certain information.


Group Data:

Group data will be used for preparing the contracted Organisation Business Analysis and report generation, but individual details will be maintained confidential and MPower Mental Health Limited will ensure individual identity is not possible in its data presentation.


Whole group data information may be used for MPower Mental Health Limited business analysis and development of population mental health and well-being.


Whole group data may be used by MPower Mental Health Limited for the use of research in Mental Health and Well-being in the workplace and population.


No individual or personally identifiable data will be shared.


No Information will be sold, shared or given to external companies to be used for their own marketing purposes.


Where MPower Mental Health ltd provides services in conjunction with another company, they will not be allowed to use any information for any other purposes. In the event services are provided by another Organisation, the identity of the Organisation will be provided and details of how the information will be used.


Cookies

On logging in to the site to access the tool, several cookies will be set up to save the login information and screen display choices. Login cookies last for 2 days, and screen option cookies last for a year. If an individual selects “remember me”, their login will persist for two weeks.


On logging out of the account, the login cookies will be removed. 


Purpose of MPower SMART Mind

The purpose of the screening tool is to match the symptoms and details inputted by the user to medical conditions and any areas of potential career support. This software and platform does NOT allow direct diagnosis. Further assessment by one of MPower Mental Health Ltd healthcare Professionals, or alternative healthcare professional chosen by the individual, will be required to make any medical diagnoses.


Voluntary Participation
Participation is entirely voluntary. Individuals have the right to withdraw consent at any time, for any reason.


Risks and Benefits
The use of this tool may involve addressing sensitive or distressing topics, which could temporarily cause emotional discomfort, but the results of the tool may result in earlier access to support and/or treatment mitigating against progression to absenteeism or presenteeism related to mental health conditions.


No Guarantees

MPower Mental Health Limited cannot guarantee specific outcomes from the screening tool, any subsequent consultations or any recommended treatments. Mental health care is a collaborative process, and results may vary depending individual circumstances.


User Responsibilities
The user must agree to provide accurate and complete information about their medical history, symptoms, and any medications or treatments currently being used. They must also agree to follow MPower Mental Health Ltd recommendations or communicate any concerns about the proposed support pathway.


Termination of Support
Either the individual or the MPower Mental health Ltd may terminate the process at any time. MPower Mental Health Limited will provide appropriate referrals or recommendations for continued care if the support pathway is terminated.

In an emergency


An individual must inform NHS Urgent care via GP/NHS Direct on 111/ Local NHS Crisis team, of emergency situations, such as suicidal thoughts, self-harm, or harm to others.
